Dear Administrative Judges:
In my letter to the Atomic Safety and Licensing Board ("Board") of earlier today, I noted that Entergy Nuclear operations, Inc. ("Entergy") had recently amended its licensing documents and filed revised testimony regarding its buried and underground piping and tanks at Indian Point Units 2 and 3. In that regard, I filed (1) the "NRC Staff's Testimony of Kimberly J. Green and William C. Holston Concerning Contention NYS-5 (Buried Pipes and Tanks)," as revised December 7, 2012 (Exhibit NRCR20016); and (2) a redline/strikeout version of that revised testimony, showing changes from the previous version filed on August 23,2012 (Exhibit NRCR00016). In my letter, I further indicated that the Staff would file a revised statement of position and a revised list of NRC Staff exhibits, later today.
Accordingly, enclosed herewith are the following documents:
- 1. "NRC Staff's Statement of Position on Contention NYS-5 {Buried Pipes and Tanks)," as revised December 7, 2012 (Exhibit NRCR20015);
- 2. Redline/strikeout version of the NRC Staff's revised Statement of Position (Exhibit NRCR20015), showing changes from the previous version filed on August 23, 2012 (Exhibit NRCR50015);

- 3. A list of "NRC Staff Hearing Exhibits" (Exhibit NRCR60001), as revised December 7, 2012; and
- 4. A certificate of service for this transmittal.
The Staff intends to offer item 1 above as an exhibit in the evidentiary hearings to be held on Contention NYS-5 on December 10,2012. Item 2 above is provided herewith solely for the convenience of the Board and parties, and will not be offered into evidence. I understand that the Board intends to defer the admission of the parties' revised exhibit lists, until final exhibit lists have been submitted.
