Dear Mr. Nazar:
This letter confirms the telephone conversation between Mr. Michael Kiley of your staff and Mr.
Daniel Rich of the NRC, on February 7, 2012, concerning a joint Regulatory Conference and Pre-decisional Enforcement Conference being conducted at your request, which has been scheduled for February 21, 2012, from 1:00 p.m. to 3:00 p.m. (EST). The enclosed meeting notice provides additional details.
The purpose of this meeting is to discuss two Apparent Violations associated with maintenance of the technical support center at the Turkey Point nuclear plant. The results of NRCs inspection of this issue are available in NRC inspection report 05000250/2011005 and 05000251/2011005, available at ADAMS ML120260599.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records (PARS) component of NRC's Agencywide Document Access and Management System (ADAMS). The purpose of this joint Regulatory Conference and Pre-Decisional Enforcement Conference is to discuss two Apparent Violations associated with maintenance of the Technical Support Center. The first Apparent Violation has preliminarily been determined to be a White finding with low to moderate safety significance that may require additional NRC inspections. This Apparent Violation is also being considered for escalated enforcement action in accordance with the NRC Enforcement Policy. The second Apparent Violation is related to the failure to report a major loss of emergency assessment, offsite response, and offsite communication capability to the NRC when the Technical Support Center was not functional from December 4, 2010, to July 13, 2011. This Apparent Violation is being evaluated using the NRCs traditional enforcement process because it impacted NRCs ability to perform its regulatory function and is being considered for escalated enforcement action in accordance with the NRC Enforcement Policy.
The NRC's Policy Statement, "Enhancing Public Participation in NRC Meetings," effective May 28, 2002, applies to this meeting. The policy statement may be found on the NRC Web site, www.nrc.gov and contains information regarding conduct of NRC meetings.
