ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a Red Significance Determination Process (SDP) finding will be issued on or around May 6, 2011, to Tennessee Valley Authority (Licensee) as a result of an inspection at Browns Ferry Nuclear Plant, Unit 1. This Red finding, an issue of high safety significance, which will result in additional NRC inspections, involved the licensees failure to implement an adequate In Service Testing (IST) program on the Unit 1 outboard low pressure coolant injection (LPCI) valve, 1-FCV-74-66, that led to the RHR loop II being unable to fulfill its intended safety function.
An NOV is included based on the Licensees failure to meet technical specification limiting condition for operations for the LPCI system because the degraded valve rendered one train of the LPCI system inoperable from March 13, 2009 until October 23, 2010. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a Red finding.
It should be noted that the licensee has not been specifically informed of the enforcement action.
