Dear Mr. Kremer:

I am responding to your letter to me dated February 28, 2011, expressing your desire to have a dialogue regarding the status of the Indian Point license renewal proceeding as well as the potential for new contentions being introduced into the hearing on this proceeding. As I indicated to you during our last discussion, the license renewal inspection activities in which Region I has been involved are completed. Almost all of the work before the agency in this case involves the hearing of multiple contentions raised in the Indian Point license renewal process, a total of fourteen to date. Thus I would have to refer any such dialogue in this proceeding to one of the agencys attorneys involved in this case. I understand that a member of my staff relayed this information to your staff via telephone on March 8, 2011.

Regarding the admission of new contentions, the Atomic Safety and Licensing Board (Board) previously specified that to be timely, contentions were due to be filed by November 30, 2007, absent an extension of time. As provided in 10 C.F.R. 2.309(f)(2) and 2.309(c), any contentions filed after that date must be based upon material new information that was not available previously, or must be supported by a demonstration of good cause for the nontimely filing.

Those contentions may be accepted or rejected by the Board, depending on whether they satisfy the requirements for admissibility and timeliness. If the contentions are accepted, a hearing would be held on them. Whether the admission of any new contentions would impact the overall hearing schedule for Indian Point cannot be determined at this time. If you have any other questions about the hearing schedule or hearing-related matters for Indian Point, we suggest that you contact Sherwin Turk, Special Counsel in the Office of the General Counsel, at (301) 415-1533.
