Dear Mr. Franke:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your November 5, 2010, letter requesting an exemption of licensing fees under 10 CFR 170.11(b) for NRC review of the Topical Report on Diversity and Defense in Depth (D3) and License Amendment Request (LAR) for Florida Power Corporationss Crystal River 3 (CR-3) plant. You have requested consideration of CR-3 as a pilot plant for Digital Instrumentation and Controls, Task Working Group #6: Licensing Process, Interim Staff Guidance (DI&C-ISG-06). Your letter does not meet the fee exemption criteria; therefore, I have denied your request, as explained below.
Fee waivers are granted according to the guidelines in 10 CFR 170.11. In similar cases involving exchanges of information between the NRC and industry, a waiver is granted only when the NRC is the primary beneficiary of the requested review or report. In particular, topical reports generally do not meet this criterion. Please refer to 10 CFR 170.11(a)(1)(iii). In your letter, you state that CR-3s participation as an additional pilot plant will significantly broaden the insight gained from applying the DI&C-ISG-06. However, the NRC currently has a pilot plant for the use of DI&C-ISG-06, and the staff believes that the additional demonstrated benefit to be gained by adding CR-3 as a pilot plant for the use of DI&C-ISG-06 does not warrant a fee waiver in the public interest. Hence, I am unable to grant you a fee exemption under the provisions of 10 CFR 170.11(b).
