UNITED STATES NUCLEAR REGULATORY COMMISSION REGION II 245 PEACHTREE CENTER AVENUE NE, SUITE 1200 ATLANTA, GEORGIA 30303-1257 November 4, 2010 Mr. R. M. Krich Vice President, Nuclear Licensing Tennessee Valley Authority 3R Lookout Place 1101 Market Street Chattanooga, TN 37402-2801

SUBJECT:

SEQUOYAH NUCLEAR PLANT - FALSIFICATION OF RESPONSE WEAPON TEST FIRE RECORDS (OFFICE OF INVESTIGATIONS CASE NO. 2-2010-007)

Dear Mr. Krich:

This refers to an investigation completed by the Nuclear Regulatory Commission=s (NRC) Office of Investigations (OI) on August 11, 2010, regarding the falsification of security response weapon test fire records at your Tennessee Valley Authority, Sequoyah Nuclear Plant. The purpose of the OI investigation was to determine whether a former security training specialist willfully falsified security response weapon test records.

After considering the information developed during the investigation, the NRC has concluded that no further action is warranted regarding the falsification of test fire records. However, we will inspect the regulatory significance of the failure to conduct semiannual weapon test fire as required by, Appendix B to 10 CFR 73, section VI. G. 3(a), during the upcoming physical security baseline inspection scheduled for December 13 -17, 2010. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/NRC/ADAMS/index.html (the Public Electronic Reading Room).

Sincerely,

/RA/
