RELAXING OF SCHEDULE FOR IMPLEMENTING REQUIREMENTS OF CONFIRMATORY ORDER EA-09-060
Dear Mr. Schwarz:
On November 10, 2009, the U.S. Nuclear Regulatory Commission (NRC) issued an Order (EA-09-060) to Entergy Nuclear Operations, Inc. (Entergy), as a result of a successful Alternate Dispute Resolution session on September 15, 2009.
On October 1, 2010, Entergy provided a response to that Order requesting a relaxation of the Order to extend the required completion date for the actions specified in Section V.6.
Specifically,Section V.6 of the Order stated that:
Entergy shall provide a lessons-learned presentation to the Regional Utility Groups for the NRC regions in which Entergy operates nuclear facilities within one year of the date of the issuance of the Confirmatory Order. The lessons-learned presentation shall address the events which gave rise to the Confirmatory Order and the corrective actions taken. Entergy shall provide a copy of the proposed presentation to the Regional Administrator, Region III, for review prior to the presentation.
On September 8, 2010, Entergy provided the NRC with the proposed presentation for the Regional Utility Group meetings, which was acknowledged by the NRC. Since that time, Entergy has indicated that the Region IV Regional Utility Group meeting could not be scheduled until November 16 - 18, 2010, thus exceeding the terms of the Confirmatory Order (one year from the date of the issuance of the Confirmatory Order). Entergy stated that the meeting schedules were determined based on the availability of multiple member companies and that Entergy did not set that schedule. As provided by Section V of the Order, Entergy requested a relaxation of the completion of the actions required by Section V.6 from 1 year to 13 months.
Based on our review, the NRC staff finds Entergys response to the Order acceptable. We find that you have demonstrated good cause for relaxation of the Order, and your request for relaxation of the completion date for the actions specified in Section V.6, as required in Section V of the Order, is therefore granted.
