Dear Mr. Messick:

This is in response to your letter of June 3, 2009 (NRC Adams ML091700411), in which you indicated your safety and security concerns regarding construction of the North Carolina International Terminal (NCIT) near the Brunswick Steam Electric Plant. As discussed in our November 25, 2008, letter to you from E. Leeds, Director of the Office of Nuclear Reactor Regulation, the NRC regulates the safe and secure use of nuclear materials at the Brunswick Plant, including any changes to this facility. However, the NRC does not have the authority to regulate industrial facilities outside of the Brunswick Plant.

Progress Energy (the licensee) is aware of your concerns and is monitoring the development of the international terminal. As stated in our November 25 letter, the licensee has the responsibility under Title 10 to the Code of Federal Regulations to assess issues that affect safe operation, security and emergency planning of its facility. The NRC has the responsibility to review this information to ensure that the nuclear facility meets NRC requirements. However, the licensee and the NRC are not aware of any regulatory actions required at this time.

The NRC will continue regulating the Brunswick plant to ensure the public health and safety is maintained in accordance with the Title 10 of the Code of Federal Regulations.
