Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process finding will be issued on or about June 5, 2009, to Constellation Energy as a result of inspections at the R. E. Ginna Nuclear Power Plant. This White finding, an issue with low to moderate safety significance which may require additional NRC inspection, was associated with the procedure quality attribute of the Mitigating Systems cornerstone and affected the cornerstone objective of ensuring the availability, reliability, and capability of systems that respond to initiating events to prevent undesirable consequences. Specifically, the licensee inappropriately removed steps for lubricating the turbine-driven auxiliary feedwater (TDAFW) pumps governor linkage assembly from a planned maintenance activity. Failure to conduct this preventative maintenance led to the TDAFW pump being declared inoperable when the governor linkage became stuck, preventing the pump from developing the required discharge pressure and flow during surveillance testing in December 2008. This White finding will result in Ginna transitioning from the Licensee Response Column of the Action Matrix to the Regulatory Response Column.

The Notice of Violation is included based on the licensees failure to meet Technical Specification 5.4.1.a, Procedures, which requires, in part, that the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Quality Assurance Program Requirements (Operation), be established, implemented, and maintained. Appendix A of Regulatory Guide 1.33 includes procedures governing preventative maintenance schedules, including lubrication schedules. Contrary to Technical Specification 5.4.1.a, in March 2008, the licensee did not implement steps for cleaning and lubricating the TDAFW pump governor linkage when those steps were removed during the work planning process.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
