ME0798, ME0799 Indian Point Units 2 and 3 Appendix R exemption requests, acceptable for review By letters dated March 6, 2009, ADAMS accession numbers ML090770151 and ML090760993, Entergy submitted a request for exemptions for Indian Point Units 2 and

3. The proposed exemptions would allow the use of certain manual operator actions during the response to a fire, which are not currently allowed by 10 CFR 50.48, through the application of 10 CFR 50, Appendix R. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of these exemption requests.

The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.12 of Title 10 of the Code of Federal Regulations (10 CFR), for an exemption to the NRC's regulations the applicant must describe how they are authorized by law, will not present an undue risk to the public health and safety, and are consistent with the common defense and security. The applicant must also describe the special circumstances that are present.

The NRC staff has reviewed your applications and concluded that they do provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed exemptions in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
