KEWAUNEE POWER STATION, MILLSTONE POWER STATION, UNITS 2 AND 3, NORTH ANNA POWER STATION, UNITS 1 AND 2, AND SURRY POWER STATION, UNITS 1 AND 2 - GENERIC LETTER 2008-01, MANAGING GAS ACCUMULATION IN EMERGENCY CORE COOLING, DECAY HEAT REMOVAL, AND CONTAINMENT SPRAY SYSTEMS, RESPONSE TO EXTENSION REQUEST (TAC NOS. MD7838, MD7845, MD7846, MD7850, MD7851, MD7884 AND MD7885)

Dear Mr. Funderburk:

Generic Letter (GL) 2008-01, Managing Gas Accumulation In Emergency Core Cooling, Decay Heat Removal, and Containment Spray Systems, requests licensees to submit information to demonstrate that the emergency core cooling, decay heat removal, and containment spray systems are in compliance with the applicable regulatory requirements, and that suitable design, operational, and testing control measures are in place for maintaining this compliance. The GL 2008-01 states that each licensee is requested to submit a written response within 9-months to provide requested information and that if a licensee cannot meet the requested 9-month response date, a 3-month written response is required that describes the alternative course of action that it proposes to take, including the basis for the acceptability of the proposed alternative course of action.

By letter dated April 7, 2008 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML080980543), Dominion Energy Kewaunee, Inc., Dominion Nuclear Connecticut, Inc., and Virginia Electric and Power Company (the licensee), stated that it had a telephone conversation with Jared Wermiel, Deputy Director, Division of Safety Systems, Office of Nuclear Reactor Regulation, Nuclear Regulatory Commission (NRC), on April 3, 2008, in which the licensee requested an extension to the date for the above 3-month response to the GL for the Kewaunee Power Station (Kewaunee), Millstone Power Station, Units 2 and 3 (Millstone 2 and 3),

North Anna Power Station, Unit Nos. 1 and 2 (North Anna 1 and 2), and Surry Power Station, Unit Nos. 1 and 2 (Surry 1 and 2). In the call, the licensee verbally requested an extension to May 8, 2008, to provide the 3-month response to the GL so that it can accurately assess the scope of work required to complete the 9-month response to the GL. The licensee stated that it was granted the request.

This letter is to formally acknowledge the approval of the requested extension to the due date for submitting the 3-month response to GL 2008-01 and to document the telephone call with the NRC staff. Specifically, Dominion Energy Kewaunee, Inc., Dominion Nuclear Connecticut, Inc., and Virginia Electric and Power Company requested an extension for providing the above 3-month

response from April 11, 2008, to May 11, 2008, for Kewaunee, Millstone 2 and 3, North Anna 1 and 2, and Surry 1 and 2. The NRC staff finds that the justification for Kewaunee, Millstone 2 and 3, North Anna 1 and 2, and Surry 1 and 2 to extend the due date for the 3-month written response to GL 2008-01 to May 11, 2008, is acceptable, and the extension request is granted. This letter does not alter or change the requested 9-month response date of October 11, 2008.

By letter dated May 8, 2008 (ADAMS Accession No. ML081300282), the licensee submitted a 3-month response to GL 2008-01 for Kewaunee, Millstone 2 and 3, North Anna 1 and 2, and Surry 1 and 2. The NRC staff will evaluate your proposed alternative course of action (3-month response) for responding to GL 2008-01 and will respond appropriately.
