Dear Mr. Pham:
I wish to thank you for your time spent on June 27, 2007 presenting the NRCs overview of the License Renewal process as it applies to Indian Point and responding to statements and concerns expressed by the audience.
During your presentation I believe you stated that safety is assured by compliance with the federal regulations, specifically Title 10 to the Code of Federal Regulations. (10 CFR)
In response to my questions I believe you stated that the NRC would assure that Indian Point is and will remain in compliance with all parts of 10 CFR. I believe you may have been caught off guard by this request as we all know that some parts of 10 CFR are not applicable to nuclear power reactors. Clearly there are Parts of 10 CFR that are not applicable to power reactors such as Parts 5, 7, 8, 15, 60, 62, 63, and 76 among others.
I would appreciate it if you could clarify your public statement and provide me with a listing of those regulations contained within 10 CFR that are applicable to the design, construction and operation of the three reactors located on the Indian Point site with specific emphasis on the requirements of 10 CFR 20, 50 and 100 and all appendices. If the applicable regulations are other than those presently published in 10 CFR from the NRCs web site, I would appreciate a copy of these regulations.
