Duke Power Company LLC d*b.a. Duke Energy Carolinas, LLC McGuire Nuclear Station, Units 1 and 2 Docket Nos. 50-369 and 50-370 NRC Generic Letter 2004-02, Potential Impact of Debris Blockage on Emergency Recirculation During Design Basis Accidents at Pressurized-Water Reactors In a letter dated June 28, 2006 regarding resolution of GL 2004-02, Duke provided an update to the eleven commitments originated in a September 1, 2005 letter. These eleven commitments had various dates for completion. In addition, in an October 5, 2006 letter, Duke committed to responding to the GL 2004-02 Request for Additional Information (RAIs) from the February 9, 2006 NRC letter within 90 days of the completion of the McGuire Unit 1 outage, not to exceed December 31, 2007. In a letter dated January 4, 2007 from the NRC to all licensees, the NRC stated that the agency expects all PWR licensees to submit supplemental responses as soon in 2007 as the information and analyses results are available; all-responses to be submitted no later than December 31, 2007. Finally, in a joint industry and NRC meeting on April 18, 2007, the NRC provided, for review and comment, a draft content guide for GL 2004-02 supplemental responses. As a result, Duke amends the commitments in the previous correspondence (June 28, 2006 and October 5, 2006) to the following:

May 3, 2007 Nuclear Regulatory Commission Page 2 In accordance with the January 4, 2007 letter issued by the NRC to all licensees and the industry / NRC meeting of April 18, 2007, Duke commits to providing, no later than December 31, 2007, a complete supplemental response which includes the following information:
- 1. An update of previously provided information,
- 2. A description of the evaluation methods used to address GSI-191
- concerns,
- 3. A summary of the evaluation results, and
- 4. How the McGuire specific details requested in the February 4, 2006 RAI letter were addressed.
Please note that the above commitment is subject to change as a result of the finalization of the content guidance being developed by the NRC (draft guidance provided in the April 18, 2007 industry/NRC meeting) for supplemental responses to GL 2004-02.
