SUBJECT:

FINAL SAFETY EVALUATION REPORT RELATED TO THE LICENSE RENEWAL OF THE NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2 (TAC NOS. MC3272 AND MC3273)

Dear Mr. OConnor:

By letter dated May 26, 2004, Constellation Energy Group, LLC (CEG or the applicant) submitted an application to the U.S. Nuclear Regulatory Commission (NRC or the staff) for the renewal of the Nine Mile Point Nuclear Station (NMPNS), Units 1 and 2 operating licenses for up to an additional 20 years. The license renewal application (LRA) was submitted pursuant to Title 10 of the Code of Federal Regulations Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The staff determined that the LRA was complete and acceptable for docketing on July 15, 2004. Since that time, the staff has reviewed the original NMPNS LRA and the NMPNS amended LRA (ALRA) dated July 14, 2005, issued requests for additional information (RAIs), reviewed the applicants responses to the staffs RAIs, and developed a safety evaluation report dated March 3, 2006. The NRC staff has previously identified two open items in its review and these have been resolved. On the basis of this review, the staff has developed the enclosed final safety evaluation report to document its findings associated with the safety review of the original LRA and the ALRA and supporting documentation for NMPNS, Units 1 and 2.
