The U.S. Nuclear Regulatory Commission staff (the NRC or the staff) and representatives of Constellation Energy Group, Inc. (CEG or the applicant), held a telephone conference call on January 23, 2006, to discuss and clarify issues related to the Nine Mile Point Nuclear Station, Units 1 and 2 license renewal application.

The telephone conference call further clarified the intent of the staffs questions and the applicants proposed responses. On the basis of the discussion, the applicant was able to better understand the staffs questions. No staff decisions were made during the meeting, and the applicant agreed to provide information for clarification in their final responses. provides a listing of the conference call participants. Enclosure 2 contains items discussed with the applicant.

The applicant has had an opportunity to comment on this summary.

OF A TELEPHONE CONFERENCE CALL HELD ON JANUARY 23, 2006 BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND THE CONSTELLATION ENERGY GROUP INC. CONCERNING THE REVIEW FOR THE NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2, LICENSE RENEWAL APPLICATION January 23, 2006 Two issues were discussed:

(1) TLAA 4.7.5, ?Reactor Water Cleanup System Weld Overlay Fatigue Flaw Growth Evaluations (NMP1 Only)

On December 20, 2005, Constellation Energy Group (CEG) submitted its annual update for the amended license renewal application (ALRA) for Nine Mile Point Nuclear Station, Unit 1 (NMP1). The annual update is required by Title 10 of the Code of Federal Regulations Part 54.21(b) (10 CFR 54.21(b). In the update, CEG included Section 4.7.5, ?Reactor Water Cleanup System Weld Overlay Fatigue Flaw Growth Evaluations (for NMP1), as a new time-limited aging analysis (TLAA) for the ALRA. CEG also included Section, A.1.2.5.2, ?Reactor Water Cleanup System Weld Overlay Fatigue Flaw Growth Evaluations, which provides the applicants FSAR Supplement summary description for TLAA 4.7.5. CEG based the acceptability of TLAA 4.7.5 on compliance with 10 CFR 54.21(c)(1)(I), in that the previous analysis was determined to remain valid for the period of extended operation.

In the telephone conference call held with the U.S. Nuclear Regulatory Commission (NRC) staff on January 23, 2006, CEG confirmed the TLAA 4.7.5 was applicable to the overlay repairs that had been performed on reactor water cleanup (RWCU) welds 33-FW-22 and 33-FW-23A. CEG stated that it performs routine ultrasonic testing (UT) examinations of the RWCU weld overlays to monitor for potential growth of the existing flaws into the overlays and for additional degradation of the components. CEG also stated that these UT examinations would be continued for the period of extended operation as part of Aging Management Program (AMP)

B2.1.6, ?BWR Stress Corrosion Cracking Program.

The 10 CFR 54.21(c)(1)(iii) permits applicants to accept TLAAs against the requirements of 10 CFR 54.21(c)(1) if the applicants can demonstrate that ?the effects of aging on the intended function(s) will be adequately managed for the period of extended operation. The staff indicated that CEG could use 10 CFR 54.21(c)(1)(iii) as an alternative basis for the dispositioning of TLAA 4.7.5, and this will credit the UT examinations with the management of stress corrosion cracking in the applicable RWCU weld overlays. When applied, this would enhance the appropriate program attributes in AMP B2.1.6, (e.g., the Scope of Program, Detection of Aging Effects, Monitoring and Trending, Acceptance Criteria program attributes).

CEG stated that it will consider crediting the UT examinations and agreed with the staff that enhancing the AMP B2.1.6 appropriately could be used as a basis for accepting the TLAA 4.7.5 against the criteria of 10 CFR 54.21(c)(1)(iii).

(2) TLAA 4.7.1, Biological Shield (NMP2 Only)

The staff stated that as part of the review for this TLAA received in the NMP ALRA, a Request for Additional Information was previously issued to the applicant regarding the methodology used to calculate the neutron fluence and NMP committed to provide an analysis using an NRC approved methodology. The staff also asked if there was any update regarding the commitment.

NMP stated that an analysis using the NRCs approved methodology for neutron fluence (same analysis used for Upper Shelf Energy and Pressure-Temperature curves for which an SER has been issued) was available to determine the neutron fluence at the biological shield inner wall.

This analysis concluded that the neutron fluence was approximately 6.2E16 n/cm2 and, therefore, the aging effect assumed on the biological shield wall (i.e., thermal embrittlement) was no longer applicable (less than the threshold of 1E17 n/cm2). Based upon this new information, TLAA 4.7.1 could be withdrawn.

The staff stated that this appears to be the case but would need to review the information prior to reaching a conclusion. As such, this issue will remain an Open Item in the upcoming staff SER and NMP can provide the necessary information in response to this staff identified Open Item.
