NOTICE OF VIOLATION (SEVERITY LEVEL II) AND PROPOSED IMPOSITION OF CIVIL PENALTY - $96,000 This is to inform the Commission that a Severity Level II Notice of Violation, with a proposed
$96,000 civil penalty, will be issued on or about December 20, 2005, to the Pacific Gas and Electric Company as a result of the licensees failure to: (1) keep adequate records of special nuclear material (SNM) inventory, transfer or disposal, (2) establish adequate procedures for control and accounting of SNM, and (3) conduct adequate physical inventories of SNM at the Humboldt Bay Power Plant (HBPP). The violations originated from a July 2004 report to the NRC which indicated that PG&E did not know the whereabouts of three 18-inch fuel rod segments. PG&Es records failed to account for the three fuel rod segments after they were cut from a single fuel rod in 1968. Likewise, PG&Es records failed to account for incore detectors after some were cut in 1973. The plant was shutdown in 1976 and has been in a SAFSTOR status since 1988. These violations were recently identified by the licensee when PG&E was examining the contents of the spent fuel pool.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
