PRELIMINARY INFORMATION - NOT FOR PUBLIC DISCLOSURE UNTIL VERIFICATION THAT LICENSEE HAS RECEIVED ACTION EN-05-035 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process (SDP) finding will be issued on or around September 7, 2005, to Exelon Nuclear as a result of inspections at the LaSalle County Station. This White finding, an issue with low to moderate increased importance to safety which may require additional NRC inspection, involved a single point vulnerability that could result in a loss of all onsite and offsite power sources to both 4160 Vac Division 1 and Division 2 safety-related buses at either of the LaSalle units. Specifically, the licensee identified a design deficiency in a common metering circuit where a postulated single failure would result in the loss of all offsite and onsite ac power to Division 1 and 2 safety-related distribution buses for both units.

A Notice of Violation is included based on a violation of 10 CFR Part 50, Appendix B, Criterion III, Design Control, and 10 CFR 50, Appendix A, General Design Criterion 17, (Electric Power Systems) because the licensee made modifications to the emergency diesel generator output circuit breakers that were not subject to design control measures commensurate with those applied to the original design. However, for the purpose of the Reactor Oversight Process (ROP) Agency Action Matrix, this issue will be characterized as an Old Design Issue consistent with the guidance in MC 0305.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
