ISSUANCE OF A NOTICE OF VIOLATION WITH NO CIVIL PENALTY This is to inform the Commission that a Severity Level III Notice of Violation with no civil penalty will be issued on or about June 22, 2005, to Entergy Nuclear Operations, Inc., as a result of inspections at the Vermont Yankee Nuclear Power Station. This action was approved by the Commission in an SRM dated June 15, 2005. This violation, which may require additional NRC inspection, involved a failure to adequately account for special nuclear material for an extended period. Specifically, the staff found that beginning in January 1980 and continuing until July 13, 2004, Entergy and its predecessor failed to: (1) keep adequate records of the location of two irradiated fuel rod pieces; (2) follow its Special Nuclear Material Inventory and Accountability procedure, when transferring the two irradiated fuel rod pieces from an open container to a closed liner in January 1980: and (3) conduct adequate periodic physical inventories since January 1980 of all special nuclear material in its possession. The inspection confirmed that both irradiated fuel rod pieces still remain in the spent fuel pool. The licensee has been contacted and has declined participation in a Pre-decisional enforcement conference.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
