REQUEST FOR COMMENTS REGARDING ENDANGERED WILDLIFE, PLANT AND MARINE LIFE RESOURCES AT A SITE IN ELKTON VIRGINIA
Dear Ms. Harrison:
The U.S. Nuclear Regulatory Commission (NRC) is requesting comments from the U.S. Fish and Wildlife Service regarding any impacts at a Merck & Company, Inc. facility. This letter is a follow-up to our telephone conversation on December 2, 2002.
Merck & Company, Inc. (licensee) has submitted a request to terminate their byproduct materials license authorizing the possession and use of small amounts of carbon 14, sulfur 35, and tritium used in research and development at their facility located at 2778 South Eastside Highway in Elkton, Virginia. This research did not involve any releases to the environment.
The NRC is considering this request. If the termination is approved by the NRC, the licensee may sell or use the property without restriction by the NRC.
The license was first issued in 1958, and the licensee has since ceased use of any licensed materials. All licensed materials have been removed from the site, and the licensee's final survey indicated that there was no contamination above the quantities permitted for release of the facility for unrestricted use. The licensee has advised the NRC that they plan to continue non radiological operations at the facility.
As part of the review plan, and under the requirements of the National Environmental Policy Act - Section 102(2)(C), the Commission seeks consultation for any Federal action which may affect wildlife, plants or marine resources. Your comments will be used in preparing the Environmental Assessment (EA) to provide sufficient evidence and analysis for determining whether an Environmental Impact Statement or a Finding of No Significant Impact should be prepared.
The Commission requests that you determine the status of this facility with respect to the National Environmental Policy Act, and advise this office of any restrictions which may be pertinent to the license termination, as affecting the wildlife, plant and marine environments. If you have any comments, please provide them within 30 days so they may be fully considered in the development of the EA document.
