ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a WHITE Significance Determination Process (SDP) finding and associated Notice of Violation will be issued on or around December 2, 2002, to Nuclear Management Company, LLC, as a result of inspections at the Kewaunee Nuclear Power Plant. This WHITE finding, an issue with low to moderate increased importance to safety, which may require additional NRC inspections, involved the lack of a fixed fire suppression system in fire area TU-95B where both trains of safe shutdown equipment could be affected by a fire. This condition represented a violation of 10 CFR Part 50, Appendix R, Section III.G.3, which requires, in part, that alternative or dedicated shutdown capability be provided where the protection of systems whose function is required for hot shutdown does not satisfy the requirements of Section III.G.2. and that a fixed fire suppression system be installed in the area. Accordingly, a Notice of Violation associated with a WHITE finding is being issued.
It should be noted that the licensee has not been specifically informed of this action. The schedule of issuance and notification are:
